The company refers to an article which was published in the Australian Financial Review on 8 December 2022 titled, "Gas project nixed by ScoMo "˜could pump by 2025'" and an advertisement which was published on Hotcopper on 12 December 2022, titled "BPH Energy plans to solve Australia's east coast gas crisis" in relation to the Company's PEP11 Project. The Company wishes to clarify that its referenced mineral resource estimate of 5.665 trillion cubic feet of gas referred to in the Articles was first announced by the Company to the ASX through a cross release on BPH by MEC Resources Limited on 22 December 2010. This information has also generally been available on the Company's ASX platform since 2010. A recent reassessment of potentially recoverable prospective resource within the present permit boundary of the PEP 11 offshore Sydney basin permit indicates a sum of the P50 estimates of all identified Prospect and Leads of 5.7 TCF.

The PEP 11 Joint Venture announces the resolution of the Federal Court Proceedings (WAD106/2022) between Asset Energy Pty Ltd and the Respondents. The proceedings involved the decision made on 26 March 2022 by the Commonwealth - New South Wales Offshore Petroleum Joint Authority to refuse Asset Energy's Application for a variation and suspension of the conditions to which PEP 11 is subject and a related refusal to grant an extension of term. The presiding Judge; Justice Jackson has agreed with the consent position reached by the parties, quashed the Decision and concluded that the Decision of the Joint Authority was affected by apprehended bias. This was because a fair-minded observer would have reasonably apprehended that the former Prime Minister of Australia the Hon Scott Morrison MP, as a member of the Joint Authority, did not bring a fair mind to determine Asset Energy's application.

Jackson J of the Federal Court of Australia has now vacated several interlocutory orders previously made in connection with preparing for the hearing of Proceeding Number WAD106/2022 between Asset Energy Pty and the Respondents; being the Commonwealth Minister for Resources et al. Bounty and BPH anticipate the Federal Court will consider the joint position to settle the matter without a trial taken by Asset Energy and the Minister and decide the matter accordingly. PEP 11 continues in force and the Joint Venture is fully in compliance with the contractual terms of PEP 11 with respect to such matters as reporting, payment of rents and the various provisions of the Offshore Petroleum and Greenhouse Gas Storage Act 2006.

In Proceedings Number WAD106/2022 between Asset Energy Pty Ltd and the Respondents namely Commonwealth Minister for Resources et al. the parties have filed proposed consent orders in the Federal Court of Australia. The proposed orders seek to end the ongoing litigation concerning PEP 11 without the need for a trial. The consent orders will only be made if the Federal Court of Australia considers it appropriate and the parties await further direction by the Court. The consent orders, if granted, will set aside the decision made in March 2022 by the Commonwealth-New South Wales Offshore Petroleum Joint Authority to refuse Asset Energy's Application for a variation and suspension of the conditions to which PEP 11 is subject and a related refusal to grant an extension of term. If the decision of the Joint Authority is set aside, then it will need to be re-made according to law.

The company provides additional information in respect of the placement. 69,928,113 shares have been issued within its remaining 15% approval limit under Listing Rule 7.1 and 75,121,887 shares under the additional 10% approval limit approved by shareholders at the last Annual General Meeting under Listing Rule 7.1A. The shares are being issued pursuant to its 10% capacity under ASX Listing Rule 7.1A in conjunction with a rights issue announced on 25 October 2018. The issue is not underwrittten and there are no fees payable in connection with the issue. Once the Company issued the 69,928,113 ordinary shares within its remaining 15% approval limit under ASX Listing Rule 7.1 there were 1,111,115,530 ordinary shares on issue. The issue of the additional 75,121,887 ordinary shares within its 10% approval limit under ASX Listing Rule 7.1A resulted in a dilution of 6.8%. The non-cash consideration received for the 75,121,887 shares issued under Listing Rule 7.1A is set out in the valuation report lodged with ASX dated 25 October 2018.

Cortical Dynamics Limited's BAR Monitor will be exhibited by the Cortical Korean distributor GLOBALUCK on 8th to 10th November 2018 at the Congress of Korean Anaesthesiology meeting in Seoul. Cortical has engaged Enable Funding to undertake a pre-IPO capital raising of up to $2 million at a price of 10 cents per share. Cortical's BARM has now been used in further successful trials at Strathfield Private Hospital in Sydney. Strathfield is part of the Ramsay private hospital group.

Cortical has signed an agreement for distribution of its Brain Anaesthesia Response monitor in the Benelux countries: Belgium, Netherlands and Luxembourg with Innomed Benelux BV. In Korea Cortical has signed an agreement with Globaluck. Globaluck distributes cardiac and a range of medical devices to the South Korean hospital market and will now obtain the approvals required to supply the BARM to the South Korean market. This distribution agreement arose as a result of an invitation by the Australian Trade and Investment Commission to attend and present at the Austrade Korean Medtech Innovation Showcase 2016. The distribution agreement with Innomed was signed on 27th April 2018 and the Korean agreement signed on 18th April 2018.

MEC Resources Ltd investee company Advent Energy Ltd says drilling at the New Seaclem 1 well off Australia's east coast has revealed a reservoir and sea pairs consisting of high-porosity Tertiary sandstones along with several formational and intraformational seals. Advent says a seismic line oriented south-west to north-east suggests there is significant updip structural potential which has not been tested. Further seismic data is required, and the joint venture will announce additional details in due course. Advent subsidiary Asset Energy is increasing its interest in PEP11 from 25% to 85% on completion of the New Seaclem 1 well, thereby reducing Bounty Oil & Gas's interest from 75% to 15%. Advent shareholders include MEC, BPH Energy Ltd, Grandbridge Ltd and Talbot Group Investments.
